Connecticut General Assembly Passed Manager Licensing Legislation

 

The Connecticut Chapter of the Community Associations Institute (CAI-CT) applauds the CT State Legislature for passing Bill Number 5536, an act which provides for Certification of Community Association Managers. The bill was introduced by the Judiciary Committee and co-sponsored by Representative James M. Albis, 99th District, Representative Gregory Haddad, 54th District, Representative James M. Crawford, 35th District, Representative Themis Klarides, 114th District, Representative Dan Carter, 2nd District, and Representative Elaine C. O'Brien, 61st District.

 

CAI-CT has long favored the Certification of Community Association Managers in our state. Community Association Managers are charged with the day to day business operations of condominium and community associations all across the state. Their duties include handling significant amounts of cash while conducting the business interests of the state’s many community associations. This bill promotes and requires that these professionals be certified with the National Board of Certification for Community Association Managers, also known as NBC-CAM. NBC-CAM was founded in 1995 by the Community Associations Institute (CAI). CAI created the program in response to a need for stringent professional standards of community association management.

 

Public Act 12-113: AN ACT CONCERNING CERTIFICATION AS A COMMUNITY ASSOCIATION MANAGER, LICENSURE AS A REAL ESTATE BROKER OR SALESPERSON AND THE DISPLAY OF AN OBJECT RELATED TO A RELIGIOUS PRACTICE OR BELIEF ON THE DOOR OR DOOR FRAME OF A CONDOMINIUM UNIT

 

The key features of this Act include:

-         Requirements for a criminal records check;

-         Upon application for an initial certificate of registration, the completion of a course regarding community association management AND pass the National Board of Certification for Community Association Managers’ Certified Manager of Community Associations (NBC-CAM) exam by Oct. 1. 2013 will be required.

-         Those who have been registered as Community Association Managers in Connecticut for less than 10 years must complete the course and take the exam by Oct. 1, 2014.

-         Realtors, upon license renewal, will submit proof of continuing education including, but not limited to, practices and laws concerning common interest communities.

-         No common interest community may prohibit the attachment to the entry door or door frame of an object of a religious practice or sincerely held religious belief.  (Details about object dimensions appear in the Act.)

During the next few months, our LAC plans to meet with Congressman Jim Himes of the 7th District.  Rep. Himes serves on the Financial Services Committee which interacts with HUD and FHA.  We hope to encourage Rep. Himes to join with others in the House to actively work with HUD and the FHA to modify guidelines that will foster rather than hamper the financial strength of our community associations.

 

We also hope to work with the Department of Consumer Protection regarding the details of the regulations for the managers’ licensing act.
